What leave of absence laws apply to small businesses in Maine?

Employers in Maine are subject to the federal Family and Medical Leave Act (FMLA), the state Maine Family and Medical Leave (ME FML), the federal Americans with Disabilities Act (ADA), and the new state paid leave, Maine Paid Family and Medical Leave (PFML). Employers with fewer than 50 employees are exempt from the FMLA. Employers with fewer than 15 employees are exempt from ME FML.

Employers in other states, like Massachusetts, Connecticut, New York, and New Jersey, have their own paid leave laws, which Range Culture Co. can help navigate. Don’t forget! Your remote employees working from other states are subject to the employment laws in those states, including their leave laws.

 

What should I do when an employee requests a leave of absence?

Start by identifying which leave laws and benefits apply and whether the employee is eligible for them. Provide required notices, get appropriate medical certification if applicable, and document everything in writing. Many small businesses make costly mistakes by handling leave informally; a verbal agreement is not sufficient. Can I require an employee to use PTO during FMLA leave?

In some cases, employers can require employees to use accrued PTO concurrently with unpaid job protection leave, provided this is stated in your written policy. However, the rules around intermittent leave, reduced schedules, and paid leave coordination are nuanced. Having a clear written LOA policy in place before a leave request arrives is essential.

Maine does not allow employers to require employees to use their PTO with ME PFML. Employees can use it to “top off”, but employers can’t require it.

Employers may never require employees to exhaust their PTO before taking leave under federal or state protections.

What happens if I mishandle a leave of absence request?

Mishandling leave, including denying a qualifying request, failing to properly reinstate an employee, or retaliating against someone for taking leave, can result in Department of Labor complaints, lawsuits, and significant financial penalties. These situations are among the most common sources of employment litigation for small businesses.
